Terms of Use — SomniTalk

Version 1.0 · Effective date: 29 August 2026 · Governing law: Province of Ontario, Canada

These terms govern your use of SomniTalk, the community forum at somnitalk.com, operated by SomniCharts Inc. ("we", "us"). They are separate from the SomniCharts application's own terms of service, which govern your use of the app, your subscription and your uploaded therapy data. Using this forum means you accept these terms and the Code of Conduct, which form part of them.

1. What SomniTalk is

A public discussion board about CPAP therapy and about the SomniCharts application. It is an information and discussion service only. It is not a medical service, it does not provide medical advice, and it is not a support channel for your SomniCharts account. See the Medical Disclaimer.

2. Eligibility and accounts

  • You must be 13 years of age or older to hold an account.
  • One account per person. You are responsible for everything done through your account and for keeping your password safe.
  • You must give a working email address and verify it before you can post.
  • Do not impersonate any person or organisation, and do not use a username designed to suggest you are staff.
  • Usernames must be a single continuous handle that is not — and does not look like — a real person's name, and must not be offensive, profane or impersonating. An account whose username we identify as a real name, or as offensive, is suspended until the member asks us to change it (see the Privacy Notice, section 2A).
  • SomniTalk accounts are separate from SomniCharts accounts. SomniCharts credentials do not work here. To use the forum you must register a fresh, separate account, and you must not reuse your SomniCharts username as your handle here.
  • We may refuse, suspend or remove any account, at our discretion, with or without notice — in practice we tell you why.

3. Your content

You keep ownership of everything you post. Nothing here transfers your copyright.

You grant us a licence. By posting, you grant SomniCharts Inc. a worldwide, non-exclusive, royalty-free, perpetual and irrevocable licence to host, store, reproduce, display, adapt for formatting, and distribute your content as part of the forum and its archives, and to allow others to read and quote it as the forum's features permit. This licence exists so that we can operate the board, keep the archive readable, and let search engines index it. It survives deletion of your account, because a thread that other people replied to cannot be un-published retroactively without destroying their contributions. It does not permit us to sell your content as a standalone product.

You warrant that what you post is yours to post, that it does not infringe anyone's rights, and that it does not contain another person's confidential or personal information.

4. What you may not post

Anything that breaks the Code of Conduct, and in particular anything that:

  • gives individualised medical, diagnostic or prescriptive advice to another member;
  • discloses another person's private, medical or identifying information;
  • infringes copyright, trademark or other rights;
  • is unlawful, defamatory, harassing, hateful, or sexually explicit;
  • advertises, solicits, spams, or promotes a commercial interest you have not disclosed;
  • offers, solicits or arranges the sale or exchange of goods or services (section 4B);
  • passes off another person's writing as your own (plagiarism — section 4B);
  • is generated or posted automatically, or breaches the conditions for AI-assisted content (section 4A);
  • describes how to modify a device beyond its documented settings, or otherwise creates a risk to someone's health;
  • attacks the service — automated scraping, bulk downloading, vulnerability probing, attempts to access other accounts, or anything that degrades the forum for other people.

4A. AI-assisted content

We recognise that AI writing tools are part of everyday life and we do not object to content drafted with their help. Such content is permitted on three conditions: (a) it is posted by a human member who has read it, stands behind it and is answerable for it under these terms; (b) it is on topic, relevant to the thread it is posted in, and contributes something to the conversation; and (c) its volume and frequency are those of a person taking part in a discussion, not of a feed. Unattended bots, automated or scheduled posting, and bulk AI-generated content are prohibited and are treated as spam under section 5.

4B. Commerce, links and copyright

SomniTalk is not a marketplace. You may not use the forum to offer, sell, buy, trade, give away, or solicit the sale or exchange of any goods or services — including therapy machines, masks, parts, supplies, medications, prescriptions or accounts — nor post advertisements, affiliate or referral links, discount codes, or "message me for a deal" solicitations, whether or not you disclose an interest. Any such content is removed and the account may be terminated.

Links are permitted for reference only — to sources that are relevant to the discussion and not commercial in intent. We may remove any link at our discretion.

Plagiarism is prohibited. Do not present another person's writing as your own, whether or not it is protected by copyright and whether or not you changed the words. Quote briefly, attribute the source, and link to it. Copyright infringement — reproducing a substantial part of a work without permission — is a breach of these terms and is handled under section 7, including our repeat-infringer policy.

5. Moderation and removal

We may edit, move, lock, hide or delete any content, and suspend or terminate any account, at our discretion — including content that breaks no rule but that we judge harmful, dangerous or disruptive. We are not obliged to host anything. Moderation decisions are not a contractual entitlement and are not appealable beyond the process described in the Code of Conduct.

We do not pre-screen posts. We do not endorse any member's content, and we do not verify members' claims about their qualifications.

6. Content of others, and our role as host

SomniTalk hosts content created by its users. We are not the author, publisher or speaker of member-posted content, and we do not adopt it. Under Section 230 of the U.S. Communications Decency Act (47 U.S.C. § 230) and equivalent principles in other jurisdictions, we are treated as a provider of an interactive computer service and not as the publisher of information provided by another information content provider. Moderating, editing, or removing content — or declining to — does not make us its publisher or author.

You rely on other members' posts entirely at your own risk.

7. Notices and takedowns

Send copyright, trademark, privacy and other legal notices to [email protected] (delivered to [email protected]).

For a copyright complaint, please include: identification of the work; the URL of the material you say infringes it; your contact details; a statement that you believe in good faith that the use is not authorised; and a statement, under penalty of perjury, that the notice is accurate and that you are the rights holder or authorised to act for them.

As a Canadian operator we follow a notice-and-notice practice: on receiving a compliant notice we will forward it to the member who posted the material and keep a record of it. We may additionally remove or disable access to material where we judge that appropriate, and we operate a repeat-infringer policy under which accounts that repeatedly attract valid notices are terminated. A member whose material is removed may reply to us disputing the notice.

8. Availability and changes

The forum is provided on an "as is" and "as available" basis. We may change, suspend or discontinue any part of it, including this whole board, at any time. We may amend these terms; material changes are announced on the forum and take effect when posted.

9. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the forum will be uninterrupted, secure, or error-free, or that anything posted here is accurate, complete, safe or suitable for you.

10. Limitation of liability

To the fullest extent permitted by law, SomniCharts Inc. is not liable for:

  • any medical or therapy decision made on the basis of anything read here;
  • any content posted by a member, or any interaction between members;
  • loss of data, loss of profits, or any indirect, incidental, special or consequential damage;
  • unavailability, interruption or deletion of the forum or of your content.

Because SomniTalk is provided free of charge, our total aggregate liability arising out of or relating to the forum is limited to CAD $100. Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify and hold harmless SomniCharts Inc. and its staff against claims, damages and costs arising from your content, your use of the forum, or your breach of these terms or of the law.

12. Termination

You may stop using SomniTalk at any time and may ask us to delete your account (see the Privacy Notice for exactly what deletion does). We may terminate or suspend your access at any time under section 5. Sections 3, 4B, 6, 9, 10 and 11 survive termination.

13. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, and you submit to the non-exclusive jurisdiction of the courts of Ontario.
